Article 62: In case of losing or damaging the marriage registration certificate, one may apply for a reissuance to the original marriage registration authority or the marriage registration authority in the locality where one party of the marriage has his/her residence registration.
Article 64: The conditions for accepting an application for a reissuance of marriage certificate or divorce certificate are: (1) The marriage registry has jurisdiction; (2) the persons involved have registered their marriage or divorce in accordance with the law, and maintained the status up to now; (3) the persons involved have the identity documents specified in Articles 29 to 35 of the Regulations; and the persons involved should fill the application at the marriage registry personally and fill in the Declaration of Application for Reissuance of the Certificate of Marriage Registration. If the persons involved are unable to apply for a reissuance of the certificate of marriage registration at the marriage registry for some reason, they can entrust others to handle when the archive are available for verification and the archive information is consistent with the identity information. For entrusted application, the household registration and ID card of the persons involved and power of attorney notarized by the notary office shall be submitted. The power of attorney should state the names and the ID numbers of the persons involved, the handling time and unit of marriage registration, the current marital status, the reason for entrustment, the name and the ID number of the trustee. The trustee shall submit his/her identity document at the same time. If the marriage registration archive of the persons involved cannot be found, they shall provide sufficient evidence to prove the marriage relationship. The marriage registry shall examine the evidence strictly, and may reissue the marriage certificate for the persons involved after confirming there is a marriage relation between them.
