Required materials: If a Chinese citizen voluntarily divorces a foreigner in China’s Mainland, or a China’s Mainland resident voluntarily divorces a Hong Kong resident, a Macao resident, a Taiwan resident, or an overseas Chinese in China’s Mainland, both parties should jointly apply to the Marriage Registry of the Civil Affairs Bureau in the permanent registered location of China’s Mainland resident, and submit the following certificates and supporting materials:

1. Household register and ID card of China’s Mainland resident, valid personal exit-entry permit for travelling and ID card of Hong Kong resident, Macau resident or Taiwan residents, valid passport or other valid international travel documents of overseas Chinese or foreigner;

2. Original marriage certificate (one copy or two copies; if both copies are lost, the marriage file must be duplicated from the original registration authority)

3. The divorce agreement signed by both parties, which is made in triplicate (without signature and date)

4. Declaration of Application for Divorce Registration filled out by both parties, and the signature for the “Declarant” column must be completed by the declarants in front of the marriage registrar who is the administrator of oath;

5. Each party submits 2 pieces of 2-inch half-length bareheaded color individual photos.

The marriage registry shall review the certificates and supporting materials produced by the parties to the divorce registration and inquire about the relevant circumstances. If the parties are indeed willing to divorce, and have reached a consensus on the matters of child support, property, debts, etc., the registration shall be completed immediately and the divorce certificates shall be issued. If the parties are not eligible for divorce and the registration is rejected, the reasons shall be explained to the parties and the Notice of Rejecting Divorce Registration shall be issued.
